1. Acceptance of Terms

By accessing or using BushTrade, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

2. Platform Description

BushTrade is an online marketplace that facilitates connections between agricultural equipment owners and individuals seeking to rent such equipment. We also facilitate land leasing arrangements.

BushTrade is a platform provider only. We do not own, operate, maintain, or inspect any equipment or land listed on our platform. All transactions are conducted directly between users.

3. User Accounts

Registration

You must create an account to use certain features of BushTrade. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including violation of these terms or suspected fraudulent activity.

4. Listings and Transactions

For Equipment Owners (Renters)

By listing equipment, you represent that:

• You own the equipment or have authority to list it
• All listing information is accurate and truthful
• The equipment is safe and in working condition
• You will honor confirmed rental agreements
• You have appropriate insurance coverage (recommended)

For Renters (Customers)

By renting equipment, you agree to:

• Thoroughly inspect equipment before accepting it
• Use equipment only for its intended purpose
• Follow all safety guidelines and operating instructions
• Return equipment in the same condition received
• Accept full responsibility during the rental period
• Report any damage or issues immediately

5. Limitation of Liability

Equipment and Land

BushTrade is NOT responsible for:

• The condition, safety, or quality of any listed equipment or land
• Equipment malfunction, breakdown, or failure
• Any injuries, damages, or deaths resulting from equipment use
• Crop loss or business interruption due to equipment issues
• Land condition, soil quality, or suitability for intended use

Theft and Damage

BushTrade is NOT responsible for:

• Theft of equipment during or after rental periods
• Damage to equipment during rental periods
• Loss of equipment or personal property
• Any consequential or indirect damages

User Interactions

BushTrade is NOT responsible for:

• The actions, behavior, or conduct of any user
• Disputes between users
• Fraudulent listings or scams (despite our prevention efforts)
• Non-payment or payment disputes
• Breach of agreements between users

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSHTRADE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BUSHTRADE IN THE 12 MONTHS PRECEDING THE CLAIM, OR ZiG 1,500, WHICHEVER IS LESS.

6. Dispute Resolution

In the spirit of Ubuntu, we encourage users to resolve disputes through dialogue and mutual understanding. Our dispute resolution process:

1. Direct communication between parties
2. Mediation through our support team (non-binding)
3. Formal arbitration if necessary

By using BushTrade, you agree to attempt resolution through our mediation process before pursuing legal action. Any disputes shall be governed by the laws of Zimbabwe.

7. Prohibited Activities

You agree NOT to:

• Post false, misleading, or fraudulent listings
• Use the platform for illegal activities
• Harass, abuse, or discriminate against other users
• Attempt to circumvent our payment or security systems
• Use automated tools to scrape or access our platform
• Interfere with the proper functioning of the platform
• Impersonate other users or BushTrade staff

8. Intellectual Property

All content on BushTrade, including logos, designs, and software, is owned by BushTrade or its licensors. You may not use, copy, or distribute this content without our written permission.

By posting content (listings, reviews, etc.), you grant BushTrade a non-exclusive, royalty-free license to use, display, and distribute that content on our platform.

9. Indemnification

You agree to indemnify and hold harmless BushTrade, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these terms.

10. Modifications

We reserve the right to modify these terms at any time. We will notify users of significant changes. Your continued use of BushTrade after changes constitutes acceptance of the modified terms.
